Trademark Registration in Cameroon
Why Register Your Trademark?
Without registration, you have limited legal recourse against third parties who use your brand name, logo or other signs in OAPI member states. Registration gives you: the exclusive right to use the mark in connection with the registered goods or services, the legal presumption of ownership, the ability to oppose or cancel conflicting marks, the right to license the mark and collect royalties, customs enforcement against counterfeit imports, and a valuable intangible asset that increases your company's valuation.
The OAPI Registration Process
1. Trademark search — We conduct a comprehensive search of the OAPI database to identify conflicting marks and assess registrability. 2. Filing — We prepare and file the application at the OAPI headquarters in Yaoundé, specifying the goods and services under the Nice Classification. 3. Formal examination — OAPI checks the application for formal compliance. 4. Publication — The mark is published in the OAPI Official Gazette for opposition purposes. 5. Opposition period — Third parties have 6 months to file an opposition. 6. Registration — If no opposition is filed (or if an opposition is rejected), the mark is registered for 10 years, renewable indefinitely. Standard processing time: 12 to 18 months from filing to registration.
What We Need From You
• The proposed trademark (word, logo or combined mark) • A list of goods and services to be covered (we can help classify these) • Name and address of the applicant (individual or company) • Power of attorney (we prepare this for signature) • Priority document if claiming priority from an earlier foreign filing • Specimen of the mark as used in commerce (if applicable)
